Legality Question reguarding OGL and older editons of D&D

Simply put, is a 3rd party publisher allowed to release material for pre-3.5e editions of D&D under the OGL? The game Castles & Crusades, for example, takes a lot from AD&D/1e and I want to know the exact legal information regarding using content from pre-3.xe D&D in 3rd party products intended for sale on websites/commercial use?
