[Trial] Riddletuck the Third vs. Al the Mutt and Silas

El J claps a long red wig on his head and bangs his gavel.

"Here begins the Riddletuck vs. Al and Silas trial. Be warned, I have little patience for shenanigans and badgering of witnesses or officers of the court.

"Al and Silas are accused of assault, theft, tresspassing, disturbing the peace and torture. Potential witnesses include Silas, Al the Mutt, Lord Riddletuck the Third, and sundry marksmen from the warrior's guild.

"Al and Silas, please state your pleas. If any participants in this action wish legal counsel, they should state it now."

Lord Riddletuck walks in, My Lord judge, as a legal advisor I would like to summon an old friend of mine, a celestial being by the name of Kratos, do I have permission for this?

"Is this friend to serve as your legal counsel?"

[Deus Mortus]

Yes my lord he is.

[McBish]

Al enters with McBish at his side. I plead not guilty on all counts your honor. I would like to have McBish as my legal counsel.

[Silas]

"I plead not guilty as well, and would like to have McBish also as my legal counsel."

[El Jaspero, the Pirate King]

Judge Jaspero nods. "All motions of counsel are approved. Kratos, please make your apperance and present your case."

[Deus Mortus]

Kratos appears in the court in a flash of bright light, he wears a golden armour with a white cape with the sign of Tyr, the cape gives way to his white wings.

Good day your honor, I am Kratos legal councel of Lord Riddletuck. I present his case as such may Tyr bless me with his knowledge, Lord Riddletuck was assaulted and abused by the two officers Al the Mutt and Silas, while trying to bring good to the people of the Town by constructing a funeral center. They threatened to assault a pack of demons on the cemetery grounds even after they were told it was under control. After this they continued to mentally abuse Lord Riddletuck untill the situation was taken care of by the markmen hired by Lord Riddletuck, even after this they continued to threaten and thusly mentally abuse Lord Riddletuck. I will attempt to show they are guilty of this and that their actions were a misconduct on their part. I shall do this as a neutral party even though I represent Lord Riddeltuck, so bless me Tyr.

The judge raises an eyebrow and shifts his long, red wig. "A follower of Tyr representing those who consort with demons. This should be interesting...

"McBish, please make your opening statements."

[Deus Mortus]

If I may interject your honor before McBish proceeds, my client did not consort with demons, the demons have been killed on his command the only reason the officers were not allowed to do this because he feared damage to his property and as such I rquest that that comment be scraped of the record.

[McBish]

I have no objection to Kratos's motion.

[El Jaspero, the Pirate King]

"The comment was merely an aside, but so be it; it will be struck from the record. McBish, please proceed."

[McBish]

McBish proceeds with his opening statment. Your honor these charges are so riddiculus when I first heard them I had to laugh. These officers didn't assault or abuse anyone. They might have tried to get an uncopertive citzen to stop hindering an ongoing police investigation but no where did they assault or abuse him. Al the mutt was the priamry officer in this case and had been watching the demons in the cemetary for long before this Riddletuck bought the cemetary. He was in the cemetary on a stake out for a couple of days when he noticed they were active he called in reinforcements and prepared to capture these demons, or kill if it became nessacary, which was a strong possiblity.
Officer Silas responded to Al's call for reinforcments and came and followed the orders that Al gave him. Riddletuck told the officers that he was going to take care of this, but the officers were wary letting such a dangerous job go in the hands of this town's citzens, esspecially since they had no way of knowing that these citzens were prepared to fight demons. But upon seeing the effectivness of the marksmen they agreed to leave and not arrest the "Lord" ((He doesn't do the finger thing, just his tone shows doubt of his lordship.)) or the marksmen of ubstruction of justice, but did warn Riddletuck that intefering with police buisness was a good way to end up in jail. They then left as peacefully as they came and even removed the bodies of the demons.
And your honor I wish the charges of torture to be dismissed as it is a affront to this courtroom and anyone who has been really tortured, to allow that farce of a charge to stand. McBish says this last part with deadly seriousness.

If I may intervene, misster McBish is drawing conclusions here that are up to a judge to decide, also dropping a charge like that is against everything the legal system stands for, if your clients are innocent the charges will be dropped, dropping them prematurely only creates the risk that they were true and that they will get away with it. I find your opening an insult to the legal system and unproffesional to say the least.

The only insult to the legal system are these charges. I could have asked to drop them all. But from your statments you claim that because these officers asking Riddletuck to comply with them is a form of tourter. A mockery if I ever heard one. McBish then stands silent waiting for the judges descion.

The Judge looks up from eating the potted plant behind his desk and wipes his muzzle. "Very good. Kratos, please begin."

Mr. Silas, how did you know that you had to come to the cemetery?

[Silas]

"Al sent word to the station using our new police badges."

[Deus Mortus]

When you arrived, how did the scene look and what did you do?

[Silas]

"It looked like your client was interfering with Al's work, and I asked Al what was going on."

[Silas]

For the record, is Al your superior officer?

"One of several, yes."

Is it expected that you listen to your officers no matter what happens?

"I'm certain there are some exceptions, but yes."

So if an superior is doing something wrong, is it expected from you to act?

Kratos sigh, If someone of a higher rank of you is going to f*ck up, are you expected to make sure he doesn't?

Your honor my client simply didn't understand the question I see no reason why Kratos needs to take such an insulting tone.

I did not take an insulting tone, I simply replied in a way that I would understand if I were not a warrior, I sighed because I imagine the judge might be insulted by my wording.

Judge Jaspero looks displeased indeed. "Both your tone and choice of words are objectionable. I run a clean, respectful courtroom, Kratos. Do that again and your client will be looking for another lawyer while you're in jail for contempt.

"While it doesn't say anything in the book that I've seen about a surperior officer..."fricking up", I do believe that if they were about to kill an innocent, then I should step in and stop them."

Why did you not further assess the situation when Lord Riddletuck told everything was under control?

[McBish]

Objection your honor, he is assuming that my client didn't "further assess the situation" and there has been no testimony stating he hasn't.

After hearing Al's report of what has happened and also hearing Lord Riddletuck claiming he had everything under control, why did you immediatly draw your weapon and told Lord Riddletuck he should not intervene?

[Silas]

"Because I was ordered to arrest him. Truth be told, he was interfering with police business. Wether he had the situation under control or not was not in question. Let me point out that your client did what we like to call, Vigilantism in front of myself and Al."

[Deus Mortus]

Were you aware that this was private property?

[Silas]

"Was your client aware that we were doing our jobs?"

[Deus Mortus]

Please answer my question mister Silas.

[Silas]

"No, I was not aware that it was private property. But, the police had been trying to do their job, and your client interfered."

[Deus Mortus]

Could you please tell me what the police's job was here?

[Silas]

"To get rid of the demons."

[Deus Mortus]

Why did you have to get rid of the demons?

[Silas]

"Hmm...because it was our job?" Silas takes a surly aditude and glares at Kratos.

Let me rephrase, how exactly did these demons break the law?

[Silas]

"Let me ask you this, if they didn't, then why isn't your client in a cell for murder?"

[Deus Mortus]

Kratos looks at the judge, Your honor, I cannot work with a witness who refuses to answer my questions.

[Silas]

"We were there to arrest the demons for stealing bodies."

[Deus Mortus]

And you did not realise that Lord Riddletuck also owns these bodies and never reported it as theft?

[Silas]

"We were on the case before he owned the land."

[McBish]

Objection your honor, I do not belive that Riddletuck owns the bodies in the cemetary and if need be I will bring in dozens of NPC families that will testify that they don't want there decesed family members stolen by demons.

[Deus Mortus]

Your honor, the cemetery was bought by Lord Riddletuck to ensure a good burial grounds, he also bought all right to the bodies buried within. Imagine if this was a park and he bought it, but some of the plants there were planted by people other then the park owner, would he not still own those plants?

Judge Jaspero raises an eyebrow. "From whom did Lord Riddletuck purchase the cemetery and its contents? One of those bodies is my own and I certainly did not sell it to him, nor grant permission to move it. Were it a park containing plants belonging to other people and it was purchase by someone else, those plants would still belong to the original owners unless the contract specifically said so."

[Deus Mortus]

The park was bought from the mayor and I assume she has full clearance to do so, also no one has claimed the corpses either way even though we are clearly building and make no secret of what has happened.

[El Jaspero, the Pirate King]

The judge peers at Kratos closely. "Nobody has 'claimed' these bodies? Aside from their families, descendants, friends, and the reincarnated people themselves? Just because something is unattended does not mean it is up for grabs for anybody who happens along. That's what we call 'theft' in a civil society. The remains within the cemetery are most certainly not the property of you, your client, or anybody other than a direct relative of the deceased or the deceased themselves."

[McBish]

Thank you your honor I belive that makes the last question irrelevent, and wrong then.

Very well, it seems my client and I were misjuding the nature of buying this land, if I may continue with questioning?

"Please proceed."

Mister Silas, how did you try to persuade my client to step down?

[Deus Mortus]

"By telling him that he was under arrest for interfering with police business."

So the basis for your harassment is that Lord Riddletuck was interfering with police business?

Let me rephrase, besides interfering with police work, did you have any other reason to arrest Lord Riddletuck?

Judge Jaspero nods. "While this Town does indeed have an established tradition of self-policing, it has also been established that these demons were removing remains of the deceased without their permission. Please move on, Kratos."

"Objection your honor. Graklok was not around at the time of these events, what relevance does he have to Riddletuck's accusations against us?"

Your honor, Graklok is the original gravedigger and can shed some light on the case.

Graklok comes into the courtroom.

Hewwo Evybody. Hewwo Captain! Graklok smiles and says as he enters. He proceeds to a bench near the front of the room, but not past the spectator point.

Silas glares at Kratos. "Could you possibly...oh, I don't know, shush and allow the judge to answer my objection before you open your mouth?"

Kratos looks at Silas with obvious contempt, I was explaining my witness as is usual and I would prefer some respect.

[McBish]

I'm sorry my client has been put under a great deal of stress due to these charges. I'm sure you understand. He looks at both Silas and Kratos and smiles..

Graklok, if someone wanted to rearrange the graves, how would he do that?

I meant that the demons in the graveyard were not committing a crime.

Graklok, let me specify, if someone had to move all the headstones and corpses, how would that have to be done, be as specific as you can, describe every step.

Silas stands. "And I must once again object to Kratos' lack of allowing the judge to respond to our objections."

Graklok confused. Did Graklok say sumtin' wrong? Why evybody shoutin' when Graklok 'bout ta speak?

Kratos balls his fist, but says nothing eyes closed untill he seems to relax.

Mr. Silas, it is no more then fair if I can defend my question, else the judge would not be able to formulate a proper decision on the objection. Also may I note that you are not on stand nor are you a legal representative. Your honor, if you would please have Silas be removed for disrupting the trial.

Judge Jaspero gives Kratos a look. "I am not about to remove the defendant from his own trial for merely asking a question. All present here can well imagine the gravedigger's art without a lengthy description, Kratos; if you have an argument to make, make it now so we can move on."

Very well, Graklok as an ex-gravedigger, do you think that the demons already pulling out the corpses would've sped up the process of reorganizing the graves?

[Graklok]

Graklok dunno. Demons fass..and mindy hanes, no...uh miny hands...no, uh, many hands...yeah dat's it...many hands make less work. So 'spose the could organ gwaves fasser.

Graklok seems to keep pondering this thought for a awhile, until the next question at least.

Your honor again I wonder what this has to do with the trial? Aren't we here to find out if Al and Silas assaulted Riddletuck. These questions about what the demons were doing there are pointless.

That said, I think it has been well established that Graklok was legally employed as a gravedigger under the direction of former Police Chief Supagoof so unless you have some other minutiae of gravedigging you'd like to discuss, move along, Kratos."

"Very good. Graklok, you may step down. Kratos, have you any additional witnesses to call?"

Yes your honor, I would like to call in Tinderhall, he is an expert in torture of all kinds.

Judge Jaspero looks dubious. "A torture expert? On what grounds do you call this witness?"

Just because a buisness changes names, doesn't mean it's not longer liable for actions under the old name. Look up AT&T and Monopoly laws for details on that. :smallbiggrin:

Though the torture case has been dropped, Mr Tinderhall is still a leading expert on mental assault and torture, we want him to take stand so we can show that what Silas and Al the Mutt did was an assault.

"This trial has already had more than its share of diversions. Barring an additional request from McBish, your call for this witness is denied. Do you have any other witnesses to call who actually have some bearing on this case?"

Kratos sighs, I would like to call up Al the Mutt.

Judge Jaspero nods. "This witness might at least tell us something about the case. Al, please come forward."

Al steps foward and climbs into the stand.

Al, why did you investigate the demons?

[McBish]

There were several reports about demons romaing the streets. I was the first to notice do to my pervious encounters with demons. I wanted to see what these demons were up to.

Depends on if the property is within the public domain. Which every cemetary I have encountered is.

When you encountered Lord Riddletuck he stated that "the situation was under control", why did you not investigate this further?

Because seeing as this was my case and I wasn't about to wait around and let this guy let the demons get away.

So there was currently no crime going on, you were told that the situation was under control and you did not find it necessary to take a moment to talk to the owner of the land you were on?

At the time I was unaware that anyone had bought the cemetary.

You did not know? That is odd, Riddletuck told you this as soon as he realised the situation, I don't remember you having hearing problems, nor any reasons why you shouldn't have heard this. So did you intentionally not hear it?

I heard it, but was shown no proof. Also I gave him plently of time to explain. He didn't he simply told me to leave.

You never asked about proof, is this normal routine in investigation, wait for an answer instead of asking for it?

Your honor, I am trying to show that the officer in question misconducted, to refute any claims that this was proper police work.

I wasn't investigating the ownership of the cemetary. It had nothing to do with my investigation.

No, but when I first started watching the demons the cemetary wasn't owned by anyone besides the Town. And when this guy came up and told me I couldn't go deal with the demons it made me suspicious and a little angry. Why did he want to stop me?

I had no intention of damaging anything. And he had no real reason to suspect that I was.

Really? Then you were not going to fight them up close and had ranged weaponry with you?

I didn't know I was going to fight anyone. I was there to question them. And maybe a fight might happen. And in my experiance ranged weapons tend to do more damage to the surrondings then hand to... paw combat.

Kratos blinks, Are you saying one arrow through the head will do more damage then full out melee.

I'd say one arrow through the head would do as much damage as a bite to the neck.

Al, in retrospect, do you think mistakes were made?

Yes I do. Letting your client kill the demons.

You mean to say that my client defending his property by using means which garantuee minimal damage is a mistake? Why is that?

Wholesale murder generaly isn't a good thing.

Now from how I see it, you have made many mistakes and although you skillfully dodge them, I still see them as being made and don't think an officer as experienced as you would make them, so was there anything about this specific case that irked you?
