In any event, the specific event in question was simple voyeurism. Porn is typically viewed as something intended to titilate others. Not all sex voyeurism is porn.

I saw a sitcom once where a couple were offered a really cheap, nice, hotel room with "Toys" to play with, and unknown to them the mirror was a one way mirror and the other guests were going to be watching them. One of them found out, and the whole thing was aborted, but if it had happened, I think that would have been porn.
Mind you, if there's some definition that someone can find that says it isn't porn, I will only be mildly surprised.

Now see, there's an actual answer! Of course, I'd still say even then the act was designed to be viewed by others (albeit not by the participants) whereas with the dwarves, the viewers were watching for other reasons and happened to see that.

It's an interesting debate, actually. I would say porn includes by definition some commercial intent, and that's where I would draw the line: if my gf and I are doing it, that's not porn, if we're getting filmed without our knowledge while doing it, that's still not porn, and if that video footage gets used commercially "to titillate viewers/customers" then that's when it becomes porn EVEN THOUGH none of the participants were aware they were actually producing porn at the time (also, I would say the act of producing porn in this case would be credited to whoever commercialized the clip of the unaware participants, more than to the participants themselves.)

I had a whole serious write-up ready to go about Uboa from Yume Nikki (can teleport people away, weird-looking, right size, hard to confirm its strength). But then I learned that Yume Nikki was released in 2004. So even if copyright wasn't a problem, that would be. Oh well.
