Gazurl took in his surroundings: Open terrain for good visibility, back to a corner so as to avoid an ambush, and a protruding wall segment to work off of to his advantage. Yes, this is good for him.
"Hextor, by the might of your iron grip, grant discipline to this humble servant so that he may hold fast against those who would deny the dominion of the Herald of Hell." His supplication complete, Gazurl took a step closer to the cliff segment and prepared for the worst.

If either of those fail, you're more than welcome to adjust your rolls so that you're making a Use Rope check instead of a normal Grapple check, as stated in the description of Hog-Tie in the Justiciar entry. Oh, and now that I see you you're my Dodge target from here out, just to clarify.

I only need one touch attack to hit; after that we're grappling and I'm using Damage Your Opponent checks in place of attacks. I just made all 5 in case I kept missing so it goes

You weren't reading what I posted, were you? Hog-Tie uses Escape Artist instead of grapple, and the initial swings got +7 to hit and damage. Unless your AC is 36 on the nail, you're taking 62 damage between the two attacks.

I forgot the part about +7, so you're right 62 damage. But it says that a justicar MAY use a Use Rope check instead of a grapple check and the the opponent MAY use an escape artist check instead of a grapple check*. I chose to stick with grapple checks. You can use whichever you like against the hog-tie attempt, but I'm guessing your grapple mod is higher.
*unless I'm misremembering the text, in which case I apologize, but that's what I remember; AFB at the moment

The second statement deals with how you escape once you've been bound, which logically is an Escape Artist check and deals with what you do on your next turn if I successfully bind you this turn.
The first statement says that it's resolved with an opposed check and that a Justicar can use Use Rope instead of a grapple check which reads to me like the opposed check is an opposed grapple check in which the Justicar has the option of using a Use Rope check instead of a grapple check. What is the opposed check that I can use Use Rope instead of if not a grapple check, particularly in light of the fact that it can only be used while grappling?

I'm aware of that. However, whenever one makes an Escape Artist check to escape bindings, it's made against the Use Rope check to bind the target.

Granted. Quoting the SRD on the Use Rope skill, section Bind a Character "When you bind another character with a rope, any Escape Artist check that the bound character makes is opposed by your Use Rope check. " So when you try to escape, I'll make a Use Rope check to stop you.

I consider that fact that it says I 'can make a Use Rope check instead of a grapple check' to be giving me a choice. Can you post or PM me the full text of both Hog-Tie and Improved Hog-tie so we can debate this on equal footing.

...I actually just took a look at the sample character, and the wording for his improved hog-tie clearly states Use Rope or grapple. Why they didn't do that in the class description, I have no idea.

That is a bit odd, yes, but remember there are at least 12 other competitors who probably won't be. Speaking for myself, I've just never really played grapplers and the Justicar's Improved Hog-tie seemed like it might make an interesting strategy. Speaking of which, Coup De Grace time!
