So I wish to make a character that fights unarmed and unarmored with maximum possible hit points. Current thought is some form of Human Fighter with Toughness and Durable using the bonus to an ability score in Constitution. Is this the best way? or no?
This guy would have 40 Hit Points at Level 1, 16 surges per day, at 10 Points each. (Enough to Heal himself 4 times over if needed.)
Granted his fists only deal 1d4+4 (assuming 18 Strength), Unless there's a way to increase unarmed damage further.
Spoiler
N.B. I could go Monk for less hit points and surges (-3 and -2 respectively) and have 1d8 Damage, as well as +2 bonus to AC when unarmored. So this looks like a Better option, and I guess I don't have RP him as coming from a monastery.
AC 14 (10+4 Dex)
Fort 18(10+1 Human +2 Monk +5 Con)
Ref 14(10+1 Human +3 Dex)
Will 14 (10+1 Human +3 Wis)
Attack +4
1d4+4

If you absolutely MUST be unarmed (and not just fluffed as such) go for Monk. And you're absolutely right, you don't need to roleplay your character as the classic 'monastery monk'. The class could easily just be a representation of his superior hand-to-hand fighting skills, no sacred training or inner chi or any of that stuff implied.
Access to themes would help you, but I understand you don't have many of the books or the character builder. The elemental initiate increases base damage to 1d6 and can use a ki focus to support weapon attacks. It's not up to the monk's standard, but it's worth having if you'd like to build an unarmed character around one of the martial classes (or barbarian), this might be the best starting point.
IIRC, arena fighter was suggested to you in a previous thread, as they do even better damage with improvised weapons. The drawback of this advantage comes from the fact that few improvised weapons are going to have an enhancement bonus. Training to use a ki focus is the best way to address that, so you should pick that up with either multi-class training or the aforementioned theme.
The problem with going unarmed is that it leaves you with a disastrously low AC and Reflex defense. Even sorcerers will have it better than you, and they're considered especially soft targets.

Alternatively a way to reproduce the following:
Human Ranger
Weapon Style: Ranged/Crossbow
Gnome Sight Distance (+1) Quick Loading (+1) Great Double Crossbow
To hit +7/+2
2d8+1/2 Dex 18-20/x2
720ft
Gnome Sight: Allows you to ignore up to two range increments
Distance: Doubles Range Increments
Quick Loading: Allows for an extra-dimensional space sorted, for Move action reloads.
Double- Can fire two shots before it needs reloading
Mithral Chain Shirt +4, +6, -1
Robe of Mage Armor +4 Ac
Bracers of Armor +2
Feats
H Exotic Weapon Proficiency Great Double Crossbow
1 Point Blank Shot
Combat: Rapid Shot
3 Precise Shot
6 Crossbow Sniper
Improved Combat: Many Shot
Would also be neat.

In 3.5/PF, that wouldn't have been statted that way, because all the AC boosters didn't stack.
In 4e, that's basically just a Ranger with a Superior Crossbow and maybe Speed Loader.

There's a paragon path for that. Snapping Testudo. It's silly, but it works.

It's a Superior Crossbow and you're some sort of Ranger. Hunter-Ranger I'd suggest because you get a quick loading feat for free.

The above don't stack - you only get the benefit of one of the +4s.

Either classic ranger or hunter ranger with Crossbow Expertise and Superior Crossbow covers most of that. Shooting into combat can be done a few ways. And many shot is covered by Twin Strike or one of the Hunter trick shots.
