@ PersonMan: well, we haven't been awake long enough to even think about preparing spells, so even if spells refreshed you'd be left with just bard spells. Also, if the casters do anything stressful, such as engage in combat, and their spells haven't refreshed, the counter restarts. Don't you love midnight ambushes?

I know that my spells won't be ready yet (Melchia is still on watch). I know that I have to rest to regain my spells.
To CTP's question about free action vs. move action: shouting is different than speaking, which is the reason it takes more than one free action to do and the DC to hear is lower than 0.

Not sure if it's the same for spells, but it doesn't necessarily reset the counter: each interruption adds an extra hour on the time we need to rest to regain spells/powers, and any spells/power points spent within the last 8 hours from when we regain them count against our daily limit.

A number of possible reasons spring to mind. He could want to justify us reaching the caravan later in the day than we had planned without handwaving in a sudden, unprovoked increase in speed on their part. He could want our characters to bond in combat in lieu of another "threaten to murder the new guy" scene.
But apparently he's logged in, and is perfectly capable of explaining himself.

Because nighttime ambushes are fun for the DM! Plus, I don't want to give you the easy challenge of only one CR-appropriate encounter per day, and you don't want to have an over-CRed fight at level 2.
I just made sure that you wouldn't have to remember that rule by having it happen at the start of the night. Plus, it makes sense for reasons unknown to you that it happens now.
EDIT: oh yeah also what Z said! I want to see you two's reaction of waking up to a thornwolf assault and a random dude casting spells next to you, so far, with no clear side (I mean, Obscuring Mist is a defensive buff for you and the wolves too - nothing is telling you that he is on your side...)

In unrelated news, OotS just hit a new high for me. Things are getting SO epic right now.
That attack roll was the concentration check, I just didn't label it as such since it replaces the attack roll.
As for the miss chance...

From how I understand it, you roll a Concentration check against the target's AC, and if that succeeds, then you make an attack roll against their flat-footed AC. If you fail the Concentration check, you still make an attack roll, but at a -2 penalty and no bonus damage dice.
