If it were to total incapacitation or surrender, he would probably be able to outlast her since she wouldn't go for a killing blow. These terms are fair. She signals her agreement by dashing forward, feinting a lightning slash at his foot, then slicing at his sword arm in an attempt to surprise him.

Kyne doesn't even look like she's paying attention. Her guard isn't perfect, but there's no obvious weakness that would indicate a trap. But she doesn't even pivot to face him, so he can circle all the way around behind her.
