    So Delmuth wouldn't offer it, hunter, survival of the forest and such. Do we offer them the chance to surrender and take their dead? Or do we just kill them?? I can see reasons for both courses of action, and them refusing to surrender doesn't really harm us any. However we could gain a bit of information/lore that we wouldn't if they do at the expense of armor we can't sell, and a bit of loot.

    IC, I'm sticking with Faurgar's earlier sentiment - we need to kill them all to prevent them from reporting us to their superiors. Capturing them and then letting them go is unlikely to lead to anything other than them scuttling back to the Constable to report our "unprovoked attack".

    However, if someone has the means to compel them to not report us to their superiors, capturing them and interrogating them becomes more doable.

    Okay, what about other, non zhent enemies that are intelligent? Do we give them a chance to surrender once we are clearly winning or do we just kill them?

    I neve play murderhobos, unless the game is munchkin and explicitly murderhobo. But I also like to imagine combat as violent and sudden. A round is 6 seconds: since they threatened us there have been 12 seconds of action fighting deadly foes who are trying to kill us, the rest is metagaming.

    I would determine that on a case-by-case basis, based on a number of factors such as:

    1. Who are the enemy and what do we know about them? Some foes will be vicious enough that they may deserve death for present or past actions. Other may be known to be treacherous and unreliable, making any promises they make suspect (e.g. Red Wizards). Faurgar, not being a good-aligned person, would not normally risk his time or his life to capture an enemy like that.

    2.If Faurgar is attacked, he will defend himself and doesn't feel an obligation to give the attacker the chance to surrender unless the attack was clearly a misunderstanding or the enemy was never a credible threat to begin with. Of course, the attacker may offer to surrender at any time if they're overmatched and don't want to fight to the death. Faurgar would accept such a surrender unless it's from an enemy as in 1.

    3. If the party decides to attack someone, the goal of initiating conflict had better be clear from the beginning. That goal could be "kill everyone", or it could be "capture an enemy for interrogation", or it could be "drive off the enemy", or any number of other goals. As long as it doesn't compromise the party's goals, Faurgar would both give en enemy the chance to surrender and accept an offer of surrender in such a situation.

    In the current fight, the situation is that this group of Zhentarim, who see themselves as the legitimate authority in Daggerdale, attempted to shake us down, but no one in the party made any attempt to defuse the situation before it escalated into violence. The party is thus as responsible for this becoming a fight as the Zhentarim are.

    Faurgar doesn't agree that the Zhentarim are the legitimate authority here, so from his perspective this was pretty much equivalent to being waylaid by bandits. However, these bandits are part of a very large and powerful organization, which will definitely declare all of us outlaws if they find out we fought against this patrol. Further, the Zhentarim are not unlike the Red Wizards in their ambition and operating style. Faurgar thus doesn't trust a Zhentarim to keep their word if they surrender, but he doesn't consider them personal enemies in the same way as Red Wizards.

    Given this, he doesn't think we should offer the remaining soldiers the chance to surrender - better to kill them, hide the bodies, and be done with it. However, should they offer to surrender on their own, he won't kill them out of hand. How to deal with them once they're disarmed - and above all how to prevent them from reporting us to their comrades without killing them - will be for the group to solve together. (Maybe one of our many spellcasters has some spells that could be useful?)
