You damn well can sue even if someone's not making money off it. Not making money reduces the damages they can get, since they can no longer demand the money you made plus additional damages plus court costs but have to settle for the last two. But they can still sue free webcomics.
What you can't sue for is use in a parody. Which this is.

I was just about to say that. No way you can be sued, at least they aren't going to risk it. It's called the Fair Use Doctrine. For one, it's satire; courts sometimes decide that doesn't qualify for fair use, but in this case the line between satire and parody (parody is always allowed) barely exists. They're not going to sue on the off chance that they're going to get a judge who's just a spiteful bastard all the time.
Also, more to the point of the Doctrine, you're not trying to supersede the object for personal gain.
Short answer: they can sue you, but they'll be at a huge dissadvantage. I mean Shire vs. Mordor level of dissadvantage.Last edited by Hungry Kobold; 2008-02-28 at 04:19 PM.

In any case, there would be little point in a lawsuit from Wizards. Unless Zarah is fabulously wealthy, they would probably lose more in legal expenses than they could gain, even if they won.
I suppose Wizards could go to court for the sake of "protecting their brand," but again, I think the animosity they would generate in the gaming community would outweigh any "benefits" they could foresee. I sure as hell wouldn't forgive Wizards for going after some guy for making a frickin' webcomic, especially a decent one like Anti-Heroes, and hopefully a lot of other people would be rankled as well.
So let's all make a pledge that if Wizards ever shuts down Anti-Heroes, we sent their office a deluge of letter bombs, OK?
P.S. If you are fabulously wealthy, Zarah, give me some money.

Letter bombs are ineffective given that Wizards is America-based, which is pretty darn cracked down for terrorist possibilities.
No, if we wanted to take Wizards to any capacity we'd need to get to the building personally or virtually.
Should the lovely Zarah be able to pay for my plane ticket (Still the safest way to travel), I'd be happy to render certain "services" to the task or tasks at hand.
